The ethics framework is not keeping up. The ABA Model Rules of Professional Conduct were written for human lawyers. State bar guidance on AI is inconsistent, evolving, and often insufficient. Practitioners are navigating this gap between powerful tools and uncertain professional rules — and the consequences of misjudgment are severe.
What AI Is Actually Doing in Law Firms
Contract review and analysis is the dominant use case. AI tools that flag non-standard clauses, identify missing provisions, summarize key terms, and compare drafts against playbooks are now in use at the majority of AmLaw 200 firms and a growing share of mid-market firms. Where the Malpractice Exposure Lives
